Cancellation Policy:

Thank you for considering our services. We understand that sometimes circumstances may arise, requiring you to cancel a scheduled session. In order to provide the best possible service to all our clients, we have established the following cancellation policy:

1. Cancellation within 48 hours: If you cancel your session less than 48 hours before the scheduled time, any payment made will be credited towards another session. We require a minimum notice of 48 hours to accommodate other clients who may be interested in booking that time slot.

2. Rescheduling: If you wish to reschedule your session instead of canceling, please notify us as soon as possible, preferably with at least 48 hours notice. We will make every effort to find an alternative date and time that works for both parties.

3. No-shows: If you fail to attend the scheduled session without prior notice or cancelation, the payment made for that session will be non-refundable and cannot be credited towards future sessions.

4. Emergency situations: We understand that emergencies can happen, and we will assess each situation on a case-by-case basis. Please contact us immediately if you encounter an unforeseen circumstance that prevents you from attending your session.

Photography Terms of Service:

These terms of service ("Agreement") govern the relationship between Talley Arce Photography ("Photographer," "we," or "us") and the client ("Client," "you," or "your") in relation to the photography services provided by the Photographer. By engaging our services, you agree to be bound by this Agreement.

1. Scope of Services: The Photographer will provide professional photography services as agreed upon between the parties. The specific details, including the date, time, location, and duration of the session, will be mutually agreed upon prior to the shoot.

2. Payment and Cancellation: Payment for the photography services is due according to the agreed terms. In the event of cancellation by the Client, any payments made are non-refundable unless otherwise stated in writing by the Photographer. Rescheduling requests are subject to availability and must be made within a reasonable timeframe.

3. Copyright and Usage: The Photographer retains the copyright to all images captured during the session. The Client is granted a personal, non-exclusive, non-transferable license to use the images for personal purposes only, including printing, sharing on social media, and displaying in personal albums. Commercial use of the images requires written permission and may incur additional fees.

4. Model Release: The Client grants the Photographer the irrevocable and unrestricted right to use and publish images taken during the session for promotional, advertising, and other related purposes. If there are individuals under the age of 18 involved in the session, the Client represents that they are the legal guardian and has authority to consent to the use of the minor's likeness.

5. Liability: The Photographer will exercise reasonable care in capturing and delivering high-quality images. However, in the event of unforeseen circumstances or technical issues, the Photographer's liability is limited to reshooting the session or refunding the payment made by the Client. The Photographer is not liable for any indirect, consequential, or incidental damages.

6. Privacy: The Photographer respects the privacy of the Client and will handle all personal information provided in accordance with applicable data protection laws. The Photographer will not share or disclose any personal information to third parties without the Client's consent, except as required by law.

7. Force Majeure: The Photographer shall not be liable for any failure or delay in performing its obligations under this Agreement due to circumstances beyond its reasonable control, including acts of God, natural disasters, government actions, or equipment failure.

8. Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Photographer is based. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

9. Invoice Terms: By making payment for the photography services, you acknowledge that you have reviewed and agree to the terms outlined in the corresponding invoice. The invoice terms specify the pricing, payment schedule, and any additional services or products included in the package. By submitting payment, you confirm that there are no hidden assumptions or agreements outside of what is explicitly stated in the invoice and its accompanying contract.

Any modifications or amendments to the invoice terms must be agreed upon in writing by both parties prior to the payment due date. Failure to adhere to the invoice terms may result in additional fees, adjustments to the services, or cancellation of the agreement at the discretion of the Photographer.

 

By submitting payment, you affirm that you have carefully reviewed the invoice details and understand the financial obligations associated with the photography services provided by the Photographer.

 

Please note that the invoice terms are considered an integral part of this Agreement and are subject to the same governing laws and jurisdiction as outlined in Section 8.

 

By continuing with the payment process, you indicate your acceptance and agreement to the terms specified in the invoice.
